Membership Enrollment and Cancellation Agreement
I (the undersigned) understand that IF the "member" is enrolled in a trial period, upon completion of the trial period, the membership will automatically renew at the rate listed below.
Right to Cancel: To cancel your trial period, we require a 48-hour written notice. If you do not cancel your trial period within 48 hours of the start of the regular membership, this agreement will be legally binding on you.

- I elect to pay my monthly tuition payment with the listed credit/debit card.
- The undersigned hereby promises to pay to the order of Achieve Martial Arts the monthly tuition listed above in recurring monthly payments, payable on the same day each month, commencing on {start_date}. Monthly memberships automatically renew until membership cancellation.
A late charge of ten dollars ($10) will be assessed for any payment five (5) days past due. Finance charges will be assessed on balances over thirty (30) days past due. Interest will be charged to the legal limit. Any and all legal remedies will commence on all accounts past due for ninety (90) days. As required by General Obligations Law, you have certain rights to cancel this agreement. These are set forth in full below.
Student Membership Agreement & Release
I (hereinafter referred to as "Student") understand that under the terms of this agreement, Achieve Martial Arts obligates itself to furnish me with instruction and suitable facilities for lessons. All class sessions are supervised by qualified personnel trained in the procedures of martial arts.
Student hereby represents that he/she has NO PHYSICAL DEFECT OR CONDITION which would render him/her unfit to receive and participate in the prescribed course of instruction. Student understands that training, lessons, instruction, and contests could involve some physical contact with the instructor and other members, which may occasionally result in accidental personal injury. Student also understands that training, lessons, instruction, and contests involve strenuous physical exercise. Student agrees that in the event he/she becomes physically unable to participate therein, he/she will immediately notify Achieve Martial Arts in writing.
It is required that the Student obey the rules and regulations of Achieve Martial Arts and that no Student shall practice free sparring or self-defense techniques until he/she meets the following criteria, including but not limited to: (1) obtains all the necessary gear for free sparring as outlined below, and (2) has been approved for the same by the instructor. Student agrees to follow the rules for free sparring and free fighting, including but not limited to: (1) No contact is permitted to the head, face, neck, or groin, except for light contact to headgear; (2) chest protector, headgear, mouthpiece, shin-instep guards, groin cup, forearm guards, and gloves are required for all participants. All necessary gear must be purchased from Achieve Martial Arts to ensure proper protection and quality control.
Recognizing and being aware of the aforesaid, Student individually and for his/her successors, heirs, administrators, executors, and assigns, expressly ASSUMES ALL RISK OF INJURY, resulting either directly or indirectly from training, lessons, instructions, tournaments, scrimmages, seminars, camps, and parties in martial arts and/or any events relating to Achieve Martial Arts. Student hereby releases Achieve Martial Arts, its successors and assigns, and all of its employees, instructors, and related persons, firms, or corporations from any claim, demand, right, or cause of action of whatsoever kind of nature for any damage, loss, injury, suffering, or death sustained as a direct or indirect result of such activities or events.
Permission is granted to Achieve Martial Arts, and others designated by Achieve Martial Arts, to use Student's name and likeness in advertising and promoting the school in any and all media.
Student understands that his/her tuition is arranged to be made in monthly installments or paid in full and is not affected by his/her lesson schedule or attendance. No refunds for any paid tuition shall be made by reason of Student's absence, withdrawal from the program, or for any medical reason (except as required by a consumer's right to cancellation, as outlined below).
Student acknowledges and understands that membership expires when all classes are used or time expires, whichever comes first. All classes must be taken before membership expiration. Make-up classes are not permitted.
The sum stated as tuition for instruction, for the period covered by this Agreement, is not inclusive of Belt Promotion fees. Student may take promotional tests upon recommendation of the instructor. If Student takes a promotional test, the promotion fee must be paid prior to the testing date.
Student acknowledges that Achieve Martial Arts reserves the right to change the training schedule at any time without advance notice.
Membership holds may be permitted under certain circumstances with a signed Membership Freeze Form. Said form must be submitted in person, 30 days prior to the start of the membership hold date. Achieve Martial Arts reserves the right to deny any membership holds.
Memberships are not transferable to anyone else.
Cancellation: To cancel a membership, a Cancellation Form must be requested and submitted thirty (30) days prior to the final day of membership and must be submitted in person or by certified mail.
Consumer's Right to Cancellation: Student may cancel this contract without penalty or further obligation within three (3) business days from the date of this Agreement. Notice of cancellation shall be made in writing and submitted in person or mailed to Achieve Martial Arts by registered or certified mail.
If Achieve Martial Arts is not in operation for two (2) months or more, Student is entitled to his/her choice of an extension of the contract or prorated refund, except if the closing is not the fault of Achieve Martial Arts, in which case the choice of remedy belongs to Achieve Martial Arts.
